$250,000 Luxe-Adventure Sweepstakes

NO PURCHASE NECESSARY TO ENTER OR WIN A PRIZE. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. ALL FEDERAL, STATE, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.

1. HOW TO ENTER:Beginning at 12:00 a.m. Eastern Time (“ET”) on May 17, 2021 and until 11:59 p.m. on November 10, 2023 (the “Promotion Period”), you may enter the $250,000 Luxe-Adventure Sweepstakes (the “Sweepstakes”) by visiting the Atlas Oceans Voyages website www.atlasoceanvoyages.com/sweepstakes (the “Website”) and completing and submitting the online entry form. Incorrect and incomplete entries are void. These official rules are also available on the Website. The Promotion Period consists of ten (10) Entry Periods (each an “Entry Period”), which are specifically detailed in the chart below.

All entries must be received by the end of the Promotion Period to be valid. There is a limit of one (1) entry, per valid email address, per eligible person, per day. For purposes of this Sweepstakes, a “day” begins at 12:00 a.m. ET and ends at 11:59 p.m. ET unless specified otherwise. If multiple entries are received from an entrant in a day, only the first entry will be accepted and additional entries will be disqualified. Multiple participants are not permitted to share the same email address. Any attempt by you to obtain more than one (1) entry per day by using multiple/different email addresses, identities, registrations or logins, or any other methods may void your entries and you may be disqualified from the Promotion. Any use of robotic, repetitive, automatic, programmed, or similar entry methods or agents (including, but not limited to, sweepstakes entry services) will void all entries by you. In the event of a dispute as to any online entry, the authorized account holder of the email address used to enter will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winner may be required to show proof of being the authorized account holder.

BONUS ENTRIES: During the Promotion Period, after an entrant submits an initial entry through visiting www.atlasoceanvoyages.com/sweepstakes (the “Website”), entrant may follow the links and instructions on the widget provided on the Atlas Ocean Voyages Website to receive bonus entries; one (1) bonus entry per day per person for sharing on Facebook and one (1) bonus entry for sharing on Instagram. Maximum of two (2) social media sharing bonuses per day per person throughout the Promotion Period.

REFER A FRIEND BONUS: Entrant may “refer a friend” by providing the e-mail address of friend or family member to the $250,000 Luxe-Adventure Sweepstakes. Referred person must enter the sweepstakes in order for referrer to receive a bonus entry. Multiple bonus entries may be received in connection with the “refer a friend” bonus. Entries generated by script, macro or other automated or mechanical means or means which subvert the entry process will be void.

MAIL-IN BONUS: To receive a bonus entry without sharing on Facebook. Instagram or referring a friend, on a 3″ x 5″ piece of paper, hand-print your name, complete address, daytime and evening telephone numbers (area code included), and date-of-birth, and mail entry in a properly stamped #10 envelope to: $250,000 Luxe-Adventure Sweepstakes, PO Box 52822, Knoxville, TN 37950. Bonus entry requests must be postmarked by November 10, 2023 and received by November 17, 2023 to be eligible. Limit one (1) entry per stamped envelope. Mechanically reproduced or pre-printed mailing labels or entries generated by script, macro or other automated or mechanical means and entries by any means which subvert the entry process will not be accepted. Mechanical stamping machines are acceptable. Incorrect, illegible, corrupt, and incomplete entries are void.

2. ELIGIBILITY: This Sweepstakes is open only to legal residents of the 50 United States and D. C. who are twenty-one (21) years of age or older as of May 17, 2021. Void where prohibited. Employees, members of their households and their immediate families (i.e., parents, spouse, children, siblings, grandparents, step parents, step children and step siblings) of Cruise Expedition Company LLC (“Sponsor”) and Sponsor’s parent companies, affiliated companies, subsidiaries, sponsors, advertising agencies, third party production companies, third party fulfillment agencies, respective agents, employees, officers, directors, members, successors, assigns, and Ritway, Inc. (the “Sweepstakes Entities”)are not eligible to enter or win a Prize.

5. PRIVACY: In connection with the Sweepstakes entry process Sponsor will be collecting personal data about entrants on the Website in accordance with its privacy policy. Please review Sponsor’s privacy policy located at: www.atlasoceanvoyages.com/privacy-policy. By participating in this Sweepstakes, entrants: (i) hereby agree to Sponsor’s collection and usage of your personal information and acknowledge that you have read and accepted Sponsor’s privacy policy (ii) agree to be bound by these Official Rules and by the interpretations of these Official Rules by Sponsor, and by the decisions of the Sponsor, which are final in all matters relating to this Sweepstakes (iii) release and hold harmless the Sweepstakes Entities against any and all claims, injury or damage arising out of or relating to participation in this Sweepstakes and/or use or misuse or redemption of any Prize (as defined herein); and (iv) acknowledge compliance with these Official Rules. Except where prohibited, participation in the Sweepstakes constitutes your consent to Sponsor’s use of your name, likeness, entry, and state of residence for promotional purposes in any media without further payment or consideration.

6. LIMITATION OF LIABILITY: Cruise Expedition Company LLC (“Sponsor”) and Sponsor’s parent companies, affiliated companies, subsidiaries, sponsors, advertising agencies, third party production companies, third party fulfillment agencies, respective agents, employees, officers, directors, members, successors, assigns (the “Sweepstakes Entities”)and Ritway, Inc. are not responsible for: any incorrect or inaccurate entry information; human error; technical malfunctions; failures, omissions, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, server providers, or software, including any injury or damage to your or any other computer relating to or resulting from participation in this Promotion; inability to access the Website; theft, tampering, destruction, or unauthorized access to, or alteration of entries; transactions that are processed late or incorrectly or are incomplete or lost due to computer or electronic malfunction or traffic congestion on the Internet or at any web site; printing or human or other errors; and any entries which are late, lost, incomplete, misdirected, stolen, or any combination thereof. Online submission is not considered proof of delivery or receipt. By entering, you agree to release, discharge, indemnify and hold harmless the Sweepstakes Entities and their respective parent companies, subsidiaries, their respective representatives and agents, advertising and promotion agencies, promotion partners and prize suppliers, and all of their respective affiliated companies, employees, officers, directors and shareholders, from and against all claims and damages or liability arising in connection with your participation and/or entry in the Promotion and/or your receipt or use of any prize awarded in this Promotion or due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Promotion-related activity or participation in this Promotion. Except where prohibited by law, the winner’s entry and acceptance of the prize constitutes permission for the Promotion Entities to use said winner’s names, photographs, likenesses, statements, biographical information, voices, and city and state addresses on a worldwide basis, and in all forms of media, in perpetuity, without further compensation. If by reason of a printing or other error, more prizes are claimed than the number set forth in these rules, all persons making purportedly valid claims will be included in a random drawing to award the advertised number of prizes available in the prize category in question. No more than the advertised number of prizes will be awarded. You further understand and agree that all rights under Section 1542 of the Civil Code of California (“Section 1542”) and any similar law of any state or territory of the United States that may be applicable with respect to the foregoing release are hereby expressly and forever waived. You acknowledge that Section 1542 provides that: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.” The releases hereunder are intended to apply to all claims not known or suspected to exist with the intent of waiving the effect of laws requiring the intent to release future unknown claims.

7. HOW WINNERS WILL BE DETERMINED: At the end of each Entry Period, one (1) Grand Prize Winner, one (1) First Prize Winner and one (1) Second Prize Winner will be selected by Sponsor in a random drawing from the eligible entries submitted during each of the ten (10) Entry Periods. Non-winning entries will be carried over into subsequent Entry Periods, if any. Sponsor’s decisions with respect to Prize Winners, these Official Rules, and all other matters pertaining to the Promotion shall be final and binding.

Each prospective Prize Winner will be required to sign an affidavit of eligibility and release of liability and publicity (where permitted), and return same, properly executed, within five (5) days of issuance of prize notification. If Sponsor so elects, prospective Prize Winners may also be required to submit to, and cooperate in, a confidential background check to confirm eligibility and to help ensure that the use of any such person in advertising or publicity for the Sweepstakes will not bring Sponsor into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the Sweepstakes or the Sponsor as determined by Sponsor in their sole discretion. If requested, prospective Prize Winners will agree to such background check and understand and agree that Sponsor may disqualify a prospective Prize Winner based on the results of the background check. If Sponsor is unable to contact the prospective Prize Winner within three (3) days from first notification attempt, if the prospective Prize Winner fails to complete and return all requested forms by the specified date, or if the prospective Prize Winner fails to comply with any of the requirements, his/her prize will be forfeited and an alternate prospective winner shall be selected, in Sponsor’s discretion. The odds of winning depend upon the number of eligible entries received for the applicable drawing.

Passports for Grand Prize Winners and Guests must not expire within six (6) months following the dates of travel (as determined by Sweepstakes Entities in its sole discretion) in order to be considered valid. In the event of non-compliance by the potential Grand Prize Winner, such potential Grand Prize Winner shall be disqualified and all privileges otherwise due as the Grand Prize Winner shall be terminated and an alternative potential Grand Prize Winner may be chosen from among all of the remaining applicable eligible entries received in Sponsor’s sole discretion. Each Grand Prize Winner also must acknowledge that Sweepstakes Entities have not and will not obtain or provide insurance of any kind relating to the Grand Prize and that Grand Prize Winner will be responsible for obtaining and paying for any life, travel, accident, property or other form of insurance relating to the Grand Prize. Grand Prize Winner must also complete any additional legal documents provided by Sponsor (or third party on its behalf, if applicable) with respect to the Grand Prize and return them as instructed within the timeframe specified by Sponsor or Grand Prize Winner may forfeit the Grand Prize at Sponsor’s sole discretion. Grand Prize winners and Guests may also be required to quarantine, provide proof of vaccination, and/or provide proof of a negative COVID-19 test as instructed prior to travel within the timeframe specified by Sponsor or Grand Prize Winner may forfeit the Grand Prize at Sponsor’s sole discretion. All decisions of Sponsor relating to this Sweepstakes are final. Sponsor expressly reserves the right to delay the announcement of the Grand Prize Winner for creative or technical reasons or for any other reason Sponsor deems necessary.

Total Approximate Retail Value (“ARV”) of Prizes is $250,000. The ARV is subject to change based on current market conditions at time of Grand Prize fulfillment, the time of travel, and the distance between departure and destination. Any difference between the ARV’s and the actual value, if any, will not be awarded.

If Grand Prize Winner is not available to travel on the dates specified by Sweepstakes Entities, in their sole discretion, Grand Prize Winner privileges and Grand Prize will be terminated, and an alternative Grand Prize Winner will be selected from the remaining Eligible Entries. Grand Prize Winner and Guest must travel on the same itinerary. Grand Prize Winner and Guest must travel on the dates specified by Sweepstakes Entities or the Grand Prize will be forfeited. Guest traveling with Grand Prize Winner must be at least twenty-one (21) years of age or older, unless accompanied by his/her parent or legal guardian and must sign a liability and publicity release. Children must be ages 8+ for an Antarctica cruise and ages 2+ for an Artic cruise and all other destinations. Grand Prize Winner and Guest must possess valid travel documents, including, without limitation, a valid passport, and any necessary visas in order to travel. Passports must not expire within six (6) months following the dates of travel (as determined by Sweepstakes Entities in its sole discretion) in order to be considered valid. Travel restrictions, conditions, and limitations may apply. Cruise and travel arrangements are subject to availability and must be roundtrip. Sweepstakes Entities shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by cruise lines, air carriers, hotels, or other transportation companies, or any other persons providing any of these services and accommodations necessitated by same. Sweepstakes Entities shall not be liable for any loss or damage to baggage.

All travel dates are subject to change in Sweepstakes Entities’ sole discretion. If for any reason any Grand Prize related event is delayed, cancelled, or postponed, Sweepstakes Entities reserve the right, but is not obligated, to cancel or modify this Sweepstakes in their discretion and shall award a substitute prize of comparable or greater value. The Grand Prize is transferable, non-refundable, and must be accepted as awarded, “AS IS”, with no warranty, representation or guarantee, express or implied, in fact or in law, made by Sweepstakes Entities or for which Sweepstakes Entities may be liable. Restrictions, limitations and blackout dates may apply.

Airfare for Grand Prize Winner is only provided from Atlas Ocean Voyages recognized gateways at time of travel. It is the responsibility of the Grand Prize winner to reach the closest recognized gateway at their own expense.

If a Grand Prize Winner would like to include a 3^rd person to their cruise, all costs to add 3^rd person (including, but not limited to airfare and stateroom) will be the responsibility of Grand Prize Winner. Fares are quoted in U.S. dollars, are per person, and are based on double occupancy. Fares include all standard shipboard services and facilities plus all select alcoholic beverages, gratuities for housekeeping, dining, and bar staff. A choice of land excursions in every port is also included in the cruise fare, along with private charter jet service for all Antarctica sailings, and economy roundtrip intercontinental airfare and airport transfers for all other destinations. Medical Evacuation Insurance is also included. The Cruise Fare does not include cruise port tax, security, navigation, berthing, stevedoring, or baggage handling/storage charges. Additionally, it does not include fuel surcharges, fees, or charges imposed by governmental or quasi-governmental authorities, shore excursions, sightseeing or meals ashore, taxes, visa fees, telecom, gift shop purchases, laundry or valet service, or any item or service whatsoever. Lastly, it does not include medical treatment, expenses incurred on board or ashore in connection with medical treatment, medical condition, medical debark, or spa services for which separate charges may be imposed.

Grand Prize winners are subject to terms of contract of carriage.

9. PRIZE TERMS: Arrangements for fulfillment of the Grand Prize will be made by Sponsor. All costs and expenses not specifically listed above, including, without limitation, ground transportation, tips and/or gratuities, souvenirs, personal expenses, damages to cruise line, cabins, baggage fees, currency exchange costs, passport fees, visa fees, on board purchases, on board services, and any equipment to be used in connection with the Grand Prize are solely Grand Prize Winner’s responsibility. The value of the Grand Prize will be taxable to the Grand Prize Winner as income.

All Prize Winners will be issued a 1099 tax form for the actual value of prize. All costs, taxes, fees, and expenses associated with any element of any Prize not specifically addressed above are the sole responsibility of Prize Winner. All federal, state, and local taxes, and any other costs not specifically provided for in these Official Rules are solely the Prize Winner’s responsibility. Sweepstakes Entities shall have no responsibility or obligation to a Prize Winner or potential Prize Winner who is unable or unavailable to accept or utilize a Prize as described herein. No substitution or cash equivalent of any Prize or any portion thereof permitted, except at Sponsor’s sole discretion, in which case a prize of comparable or greater value may be awarded.

Public announcements of winners are at the sole discretion of Atlas Ocean Voyages.

10.CONDITIONS OF ENTRY: Entry materials that have been tampered with or altered are void. If, in the Sponsor’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Promotion, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Promotion, the Sponsor reserves the right at its sole discretion to disqualify any individual who tampers with the entry process and void any entries submitted fraudulently, to modify, suspend, or terminate the Promotion, or to conduct a random drawing to award the prizes using all eligible, non-suspect entries received as of the termination date. Should the Promotion be terminated prior to the stated expiration date, notice will be posted on the Website. In the event of a dispute as to the identity of a winner based on an email address, the winning entry will be declared made by the authorized account holder of the email address submitted at time of entry. CAUTION: ANY ATTEMPT BY ANY INDIVIDUAL TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES FROM ANY SUCH INDIVIDUAL (INCLUDING ATTORNEY’S FEES) FROM INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

11.FORCE MAJEURE: Sweepstakes Entities shall not be liable to a prize winner or any other person for failure to supply a prize or any part thereof, by reason of any epidemic, pandemic, acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulation(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, epidemic, pandemic, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, network or computer problems, internet problems, hacking, computer viruses, unauthorized computer access, tampering, or any other cause beyond Sponsor’s sole control.

12.All issues and questions concerning the construction, validity, interpretation and enforceability of these rules, or the rights and obligations of any entrant or the Promotion Entities in connection with the Promotion, shall be governed by and construed in accordance with the laws of the State of Florida without giving effect to any choice of law or conflict of law rules or provisions which would cause the application or the laws of any jurisdiction other than the State of Florida. Any action or litigation concerning this Agreement shall take place exclusively in the federal or state courts sitting in Ft. Lauderdale, Florida, and you expressly consent to the jurisdiction of and venue in such courts and waive all defenses of lack of jurisdiction and inconvenient forum with respect to such courts.
